Vibey Terms of Service

Vibey introduction outline:

Vibey can be used for your personal, non-commercial or commercial use to create pages/upload content to promote your brand and/or cause.

You agree to only create vibey pages and upload images and/or content for which you have the full copyright and/or trademark rights. You cannot use our website for any offensive activity or illegal activity (I.e pornography, spam, scams or insulting others). You cannot post any content on our website that contains slander.

You agree that no matter what, Vibey shall never be responsible for anything; not for the serviceÕs unavailability, not for loss of data, not when others use your images or anything else, sorry.

We will never use your profile to spam others so you also agree to never use our app to spam anyone.

Eligibility:

In order to use Vibey.com you hereby represent and warrant that: you are a person that is 18 years of age that is representing yourself or a legal entity which you have the right to represent OR: If you are not 18 years old, you must be a natural person over 13 years of age and have obtained consent from your legal gaurdians to enter this terms of service.

Revocation:

You are granting the right for Vibey to revoke, terminate, or withhold for any reason at any time, the use of our services.

In order to use our service, you may be required to grant Vibey with specific permissions on accounts at various 3rd party services such as Facebook and Twitter. Although at any time you may remove these permissions from Vibey, you are acknowledging that you are giving such permissions to Vibey aslong as you use our services.

You are granting us permissions that are defined in the facebook developer guidelines / twitter agreements such as the right to access your name, profile picture, and other parts of your Facebook Profile. You are also giving us permission to store, retain, and use your email address to contact you. You are granting permission for us to post images/information on your facebook wall. You are also granting permission for us to change your twitter background as well as other twitter permissions we may request via the Twitter API.

Scope of services:

Upon registering, Vibey shall provide you with the following services:

1) Creation of a vibey profile pages: You will be able to create a page that you will name. We will provide you with a custom vibey URL (Vibey.com/URLhere). You will be able to put each profile page you created into a category that will be displayed in our directory.

2) Uploading: You will be able to upload various images to promote your brand such as facebook covers, twitter backgrounds, and other images.

3) Storage: Vibey will store and retain all of the material that you have uploaded on our website

4) Presentation: You will be able to promote your profile page with a widget code that is provided in your account or profile URL. We will provide you with statistics on how many people are using your content. Users will be able to make comments via the facebook social plugin on your profile page.

5) Posting on your facebook album: Vibey will post the work you created to your facebook profile and the profiles of individuals who visit your custom vibey page and album after permission from you is obtained.

6) Change of twitter background: Vibey will change backgrounds of users who give us permission to do so just like the facebook covers.

More legal stuff:

There is absolutely no warranty or gaurantees with our service of any kind. The content on our website is user generated and because we are unable to pre-screen all content we are taking absolutely no responsibility for what is posted. If there is something on our website that is offensive or infringing, please contact us at abuse@vibey.com to remove the content, we are happy to do so. By using our website, you agree that you are the sole proprietor or a designated licensee of any content you upload/process through our service. You are agreeing that you are fully in complaint with any laws and have full permission prior to uploading.

You agree to hold Vibey and its whole organization harmless for any claim of copyright infringement, trademark dilution or patent infridgement for any use of content according to these terms of service.

Governing Laws, Jurisdiction, No Class Action: These Terms shall be solely governed by the laws of the state of Washington in the United States of America, including their statutes regarding conflict of laws and may be solely brought to the courts of Washington. You undertake not to initiate any class action, for any reason, against Vibey and to claim your damages only according to this agreement.
